Fehmida Mirza wins thumping majority in Speaker election

ISLAMABAD, Mar 19 (APS): Dr Fehmida Mirza Wednesday won thumping majority in the election for the office of Speaker to the newly elected of National Assembly. Winning the confidence of 249 members amongst 328 members who have taken oath so far, Dr Fehmida Mirza, the PPPP and coalition partners supported candidate became the first woman Speaker of the National Assembly in country’s history by securing 249 votes.
The runner up, Israr Tareen the candidate of Pakistan Muslim League and coalition partners secured 70 votes.
After the vote count completed, outgoing Speaker National Assembly Chaudhry Amir Hussain, the only Speaker in country’s history who completed tenure in the Chair, announced the result.
In all 324 votes were cast as four members including Maulana Fazlur Rehman, Maulvi Asmatullah, Hamid Yar Hiraj and Noorul Haq Qadri could not turn up to cast their votes.
Out of total 324 votes cast 319 votes were declared valid as Fehmida Mirza secured 249 votes, Israr Tareen got 70 votes.
Five votes were invalid and no vote was spoiled or challenged.
Polling for the office of the Speaker took two hours and 20 minutes to culminate as members went to two polling booths set up for their vote casting, one by one, after their names were called by Secretary National Assembly.

پاکستان کی تاریخ کی تیرہویں قومی اسمبلی کے سپیکر اور ڈپٹی سپیکر کے انتخاب سے قبل بدھ کو پاکستان پیپلز پارٹی، پاکستان مسلم لیگ (ن)، عوامی نیشنل پارٹی اور جمیعت علمائے اسلام کی پارلیمانی پارٹیوں کا اجلاس شروع ہو گیا ہے۔
اجلاس کی صدارت پاکستان پیپلز پارٹی پارلیمینٹیرین کے صدر مخدوم امین فہیم، عوامی نیشنل پارٹی کے صدر اسفندیار ولی اور مولانا فضل الرحمان نے مشترکہ طور پر کی۔
پاکستانی ذرائع ابلاغ کے مطابق اجلاس کے شروع میں ہی وزارت عظمیٰ کے ایک امیدوار احمد مختار نے پارلیمانی پارٹی کے اجلاس سے واک آؤٹ کیا ہے۔
پارلیمانی پارٹی کے اس اجلاس میں پاکستان پیپلز پارٹی کے چیئرمن آصف علی زرداری اور مسلم لیگ (ن) کے سربراہ نواز شریف گزشتہ کئی اجلاسوں کے برعکس شریک نہیں ہوئے۔
ان دونوں اہم رہنماؤں کی پارلیمانی پارٹیوں کے مشترکہ اجلاس میں عدم شرکت کو سیاسی مبصرین بڑی اہمیت دے رہے ہیں اور خیال کیا جارہا ہے کہ یہ بات آصف زرداری اور مخدوم امین میں اختلافات ختم ہونے اور اعتماد بحال ہونے کی عکاسی کرتی ہے۔
پارٹی ذرائع کے مطابق مخدوم امین فہیم اور آصف علی زرداری میں انتخابات کے بعد سے جاری اختلافاف ختم ہو گئے ہیں اور ان کو قومی اسمبلی میں پارٹی کا پارلیمانی رہمناء مقرر کیا جا رہا ہے۔
تاہم پارلیمانی روایات کے برعکس قومی اسمبلی میں اکثریتی جماعت کے پارلیمانی لیڈر کو وزیر اعظم نامزد نہیں کیا جائےگا اور وزیر اعظم کسی اور رکن کو نامزد کیا جائے گا جس کا نام ابھی تک سامنے نہیں آیا ہے۔
سپیکر کے لیے پی پی پی اور اس کی اتحادی جماعتوں کی مشترکہ امیدوار سندھ سے تعلق رکھنے والی ڈاکٹر فہمیدہ مرزا کو نامزد کیا گیا ہے اور ڈپٹی سپیکر کے لیے ان جماعتوں کی طرف سے سرحد سے تعلق رکھنے والے فیصل کریم کنڈی کو نامزد کیا گیا ہے۔
پی پی پی اور اس کی اتحادی جماعتوں کی عددی اکثریت دیکھتے ہوئے یہ توقع کی جا رہی ہے کہ یہ دونوں امیدوار با آسانی سپیکر اور ڈپٹی سپیکر کے لیے ہونے والی خفیہ رائے شماری میں اپنے مدمقابل امیدواروں پر کامیابی حاصل کر لیں گے۔

اسلام آباد - قومی اسمبلی سیکرٹریٹ نے نو منتخب قومی اسمبلی کے اسپیکر اور ڈپٹی اسپیکر کے انتخاب کیلئے تمام تیاریاں مکمل کر لی ہیں، یہ انتخاب بدھ کی صبح گیارہ بجے قومی اسمبلی ہال میں ارکان کے خفیہ ووٹوں کے ذریعے ہو گا۔ اسپیکر کے عہدے کیلئے پیپلز پارٹی کی ڈاکٹر فہمیدہ مرزا اور بلوچستان سے تعلق رکھنے والے اپوزیشن کے نو منتخب امیدوار اسرار ترین میں مقابلہ ہوگا جبکہ ڈپٹی اسپیکر شپ کیلئے پی پی کے فضل کریم کنڈی اور ایم کیو ایم کی خوش بخش شجاعت آمنے سامنے ہونگے۔ قومی اسمبلی سیکرٹریٹ کے سیکرٹری کرامت حسین نیازی نے ”جنگ“ کو خصوصی انٹرویو میں بتایا کہ سفید رنگ کے بیلٹ پیپر طبع کرائے گئے ہیں، اسپیکر کے عہدے کے دونوں ناموں کی مہریں سیکرٹریٹ نے ہر بیلٹ پیپر پر لگا دی ہیں، سیکرٹریٹ کا عملہ ووٹر ممبر کا نام اور قومی اسمبلی کا حلقہ نمبر درج کر کے بیلٹ پیپر کی پشت پر خصوصی مہر لگا کر اور اپنے دستخط کر کے اسے ہرممبر کو جاری کر دے گا، رکن اسمبلی پسند کے امیدوار کے نام کے سامنے والے خانے کے اندر نشان لگا دے گا اور اسپیکر کے ساتھ رکھے بیلٹ باکس میں ووٹ ڈال دے گا۔ ٹرانسپیرنٹ سبز ڈھکن والے دو بیلٹ باکس بمعہ زرد رنگ کی جدید سیل کے ساتھ منگوا لئے گئے ہیں۔ بیلٹ پیپر پر نشان کیلئے جدید ووٹنگ اسکرین لگا دی گئی ہیں۔ اسپیکر کے الیکشن کی نگرانی موجودہ اسپیکر چوہدری امیر حسین کریں گے۔ ووٹنگ مکمل ہونے پر دونوں امیدواروں ڈاکٹر فہمیدہ مرزا اور اسرار ترین کے پولنگ ایجنٹوں کی موجودگی میں نتائج کا اعلان کر دیا جائے گا۔ چوہدری امیرحسین خود نتیجے کا اعلان کر کے نو منتخب اسپیکر سے حلف لیں گے جس کے بعد نو منتخب اسپیکر ڈپٹی اسپکر کے انتخاب کا عمل شروع کرے گا، رائے شماری خفیہ ہوگی۔ کامیاب ڈپٹی اسپیکر کے نام کا اعلان ووٹ گننے کے بعد کر دیا جائے گا۔ ڈپٹی اسپیکر کے انتخاب کے بعد قومی اسمبلی کا اجلاس غیر معینہ مدت تک برخاست کردیا جائیگا۔

ججوں کی بحالی کے سوا کوئی آپشن قبول نہیں،اعتزاز احسن،آزاد عدلیہ،پاکستان میں جمہوریت کا اہم ستون ہے،امریکی سفیر

سپریم کورٹ بار ایسوسی ایشن کے صدرچوہدری اعتزاز احسن نے کہا ہے کہ وکلاء کو ججوں کی بحالی کے سوا کوئی آپشن قبول نہیں اور وکلاء ججوں کی بحالی پر امریکی کردار سے بھی مطمئن نہیں،انہوں نے کہا کہ ہم ججوں کی بحالی کا سیاسی راستہ چاہتے ہیں۔دوسری جانب امریکی سفیر این ڈبلیو پیٹرسن نے کہا ہے کہ آزاد عدلیہ پاکستان میں جمہوریت کا اہم ستون ہے اور ججوں کی بحالی پاکستانی عوام کا معاملہ ہے،امریکا تو صرف پاکستان میں جمہوریت اور جمہوری اداروں کا فروغ چاہتا ہے،انہوں نے کہا کہ ہم آئینی اداروں کے استحکام اورجمہوری عمل کی ترقی کے لئے پاکستان کی مدد کرتے رہیں گے۔تفصیلات کے مطابق پاکستان میں تعینات امریکی سفیر این ڈبلیو پیٹرسن نے سپریم کورٹ بار ایسوسی ایشن کے صدر اور پی پی پی کے مرکزی رہنما اعتزاز احسن سے ان کی رہائش گاہ پر ملاقات کی جس میں ملک کی مجموعی سیاسی صورتحال ، حکومت سازی اور ججوں کی بحالی کے حوالے سے تفصیلی تبادلہ خیال کیاگیا۔ ملاقات کے بعد صحافیوں سے بات چیت کرتے ہوئے اعتزاز احسن نے کہا کہ امریکی سفیر انہیں رہائی کے بعد خیر سگالی کے طور پر ملنے آئی تھیں اور ملاقات کے دوران ملک میں جاری سیاسی عمل اور حکومت سازی پر بات چیت ہوئی ہے، وہ ججز کی بحالی کے حوالے سے کوئی درمیانی راستہ لے کر نہیں آئی تھیں اور نہ ہی ہمیں چیف جسٹس افتخار چوہدری سمیت تمام ججز کی بحالی کے سوا کوئی اورآپشن قبول ہے،انہوں نے کہا کہ آئین کے آرٹیکل 69 کے تحت کوئی بھی عدالت پارلیمنٹ کے کاموں میں مداخلت نہیں کر سکتی۔ اعتزاز احسن نے مزید کہا کہ اگر انہوں نے کوئی راز کی بات کرنی ہوتی تو دن دہاڑے مجھ سے میری رہائش گاہ پر ملنے کی بجائے رات کو تین بجے کسی نا معلوم جگہ پر ملاقات کرتیں۔اعتزا ز احسن نے کہا کہ انہوں نے امریکی سفیر کو وکلاء کے تحفظات سے آگاہ کردیا اور بتادیا کہ وکلاء آزاد عدلیہ اور ججوں کی بحالی پر امریکی کردار سے مطمئن نہیں۔ انہوں نے کہا کہ امریکی سفیر پاکستان کی سیاسی صورتحال کا جائزہ لینے کیلئے میرے خیالات سننے آئیں ، وہ سمجھتی ہیں کہ ہم ملکی سیاست سے ہٹ کر کچھ کر رہے ہیں لیکن میں نے انہیں واضح کر دیا ہے کہ ہم نے اعلان مری کے مطابق پارلیمنٹ کو تیس دنوں کا وقت دیا ہے جو کہ اس بات کا مظہر ہے کہ ہم ججوں کی بحالی کا سیاسی راستہ چاہتے ہیں۔ انہوں نے کہاکہ آئین کے آرٹیکل 69 اور احمد سعید کرمانی کیس کے تحت کوئی بھی عدالت پارلیمنٹ کے کاموں میں مداخلت نہیں کر سکتی۔ انہوں نے مزید کہا کہ ہم محاذ آرائی نہیں کرنا چاہتے لیکن چیف جسٹس افتخار چوہدری کی رہائی کے فوراً بعد ہم انہیں ملک بھر کی بار ایسو سی ایشنز میں لے کر جائیں گے اور اس مرتبہ ان کے ساتھ 45 دیگر جج اور 45 ہزار ڈرائیورز ہونگے۔دریں اثناء امریکی سفارت خانے سے جاری پریس ریلیز کے مطابق امریکی سفیر این ڈبلیو پیٹرسن نے سپریم کورٹ بار ایسو سی ایشن کے صدر اعتزاز احسن سے ان کی رہائش گاہ پر ملاقات کے دوران کہا کہ ججوں کی بحالی پاکستانی عوام کا معاملہ ہے،امریکا صرف پاکستان میں جمہوریت کا قیام چاہتاہے۔این پیٹرسن نے مزید کہا کہ امریکاپاکستان میں جمہوری عمل کے تسلسل کی حوصلہ افزائی کیلئے پاکستان کے ساتھ مل کر کام کرنے کا خواہشمند ہے۔ انہوں نے کہا کہ اس حوالے سے امریکاپاکستانی عوام کو ووٹروں کی آگاہی سیاسی جماعتوں کی ترقی انتخابی فہرستوں کو کمپیوٹرائزڈ کرنے اور ملکی غیرملکی انتخابی مبصرین کیلئے پہلے 28ملین ڈالر سے زائد امداد فراہم کر چکاہے۔

’سپریم کورٹ بحالی کی قرارداد نہیں روک سکتی‘

فل کورٹ نے سپریم کورٹ کی کارکردگی پر اعتماد کا اظہار کیا
اٹارنی جنرل ملک قیوم نے سپریم کورٹ کے باہر صحافیوں سے گفتگو کرتے ہوئے کہا کہ سپریم کورٹ پارلیمنٹ کی کارروائی نہیں روک سکتی۔
ملک قیوم نے کہا کہ پارلیمنٹ میں قراردار پیش کر کے معزول ججوں کی بحالی ایک خواہش تو ہوسکتی ہے لیکن اس کی کوئی قانونی حیثیت نہیں ہے۔ انہوں نے کہا کہ سپریم کورٹ ججوں کی بحالی کے حوالے سے پارلیمنٹ میں مجوزہ قرارداد رکوانے کے لیے حکم امتناعی جاری نہیں کرسکتی۔
ملک قیوم نے کہا کہ پارلینمٹ میں یہ قراردار منظور ہونے کے بعد یہ معاملہ سپریم کورٹ میں لایا جاسکتا ہے۔ انہوں نے کہا کہ پارلینمٹ کسی جج کو مقرر نہیں کرسکتی تو بحال کیسے کر سکتی ہے۔

‘اس سے قبل پی سی او کے تحت معرض وجود میں آنے والی سپریم کورٹ کی فل کورٹ کا اجلاس منگل کے روز چیف جسٹس عبدالحمید ڈوگر کی سربراہی میں ہوا۔ اجلاس میں تین نومبر کے بعد پی سی او کے تحت حلف اٹھانے والے سپریم کورٹ کے تمام ججوں نے شرکت کی۔
اجلاس میں ریٹائرڈ ججوں کو پینشن کے حصول میں پیش آنے والی مشکلات کو دور کرنے کے لیے اقدامات کرنے کی ہدایت کی گئی۔
واضح رہے کہ معزول چیف جسٹس افتخار محمد چوہدری سمیت پی سی او کے تحت حلف نہ اُٹھانے والے ساٹھ ججوں کو نوکری سے فارغ کر دیا گیا تھا۔ ان میں سے کسی نے بھی ریٹائرمنٹ کے کاغذات پر دستخط نہیں کیے۔
پی سی او کے تحت حلف نہ اُٹھانے والے ججوں میں سے صرف رانا بھگوان داس اپنی مدت پوری کر کے پندرہ دسمبر سنہ دو ہزار سات کو ریٹائر ہوئے۔ انہیں ریٹائرمنٹ کی تمام مراعات حاصل ہیں۔
پارلیمنٹ کے ذریعے ججوں کی بحالی ناممکن: ملک قیوم
پاکستانی میڈیا میں سپریم کورٹ کی فل کورٹ کے اجلاس کے بارے میں خاصی کوریج دی گئی۔ اس کی وجہ یہ تھی کہ اس فل کورٹ کے حوالے سے خدشات کا اظہار کیا جا رہا تھا کہ پارلینمٹ کی طرف سے معزول ججوں کی بحالی کے سلسلے میں مجوزہ قرارداد پیش ہونے سے پہلے سپریم کورٹ اس حوالے سے کوئی لائحہ عمل طے کرے گی۔
اجلاس میں جیل پٹیشنز کو جلد ازجلد نمٹانے کے لیے سپیشل بینچ تشکیل دینے کا فیصلہ کیا گیا۔ اجلاس میں بتایا گیا کہ پچیس نومبر سنہ دوہزار سات سے لیکر چودہ مارچ سنہ دوہزار آّٹھ تک تین ہزار تین سو پانچ نئے کیسز سپریم کورٹ میں درج کیے گئے۔ جبکہ اس عرصے کے دوران دو ہزار چھ سونوے مقدمات نمٹائے گئے۔ سپریم کورٹ میں اب بھی پندرہ ہزار سے زائد مقدمات زیر سماعت ہیں۔
اجلاس میں لوگوں کو انصاف کی فراہمی کے سلسلے میں مقدمات جلد از جلد نمٹانے کے حوالے سے سپریم کورٹ کی کارکردگی پر اعتماد کا اظہار کیا گیا۔
اجلاس میں جوڈیشل الاؤنسز میں اضافے کا معاملہ سپریم کورٹ کے فل کورٹ کے آئندہ اجلاس تک مؤخر کردیا۔

Special benches for quick disposal of criminal, civil cases to be constituted:Full Court

ISLAMABAD, Mar 18 (APS): Full Court meeting of the Supreme Court Tuesday expressed complete satisfaction over the disposal of cases and decided to constitute special benches of the apex court for the quick disposal of criminal and civil cases including jail petitions.
According to the press release issued by the Supreme Court here on Tuesday about the decisions of the Full Court meeting, at least one bench for hearing of cases involving death sentence and two benches for civil appeals will be constituted. The concerned office of the apex court has been directed to prepare category wise/year wise lists of cases and place the same before the Chief Justice of Pakistan for constitution of appropriate benches.
chief Justice Abdul Hameed Dogar presided over the meeting and all 15 judges of the Supreme Court attended the meeting.
Judges who attended the meeting were Justice Muhammad Nawaz Abbasi, Justice
Faqir Muhammad Khokhar, Justice Javed Buttar, Justice Saiyed Saeed Ashhad, Justice Ijazul Hassan, Justice Mohammad Qaim Jan Khan, Justice Mohammad Moosa K. Leghari, Justice Ch. Ejaz Yousaf, Justice Muhammad Akhtar Shabbir, Justice Zia Perwez, Justice Mian Hamid Farooq, Justice Syed Sakhi Hussain Bukhari, Justice Syed Zawwar Hussain Jaffery, Justice Sheikh Hakim Ali and Justice Muhammad Farrukh Mahmood.
The full court reviewed the pendency, institution and disposal of cases over the last four months. In the beginning of November 2007, the Court had a pendency of 14474 cases while 3505 more cases were filed during this period out of which 2690 cases were disposed of leaving a balance of 15289 cases.
The Full Court meeting examined the details of the different categories of pending cases.
Currently, there are 5255 civil petitions, 473 civil review petitions, 4800
civil appeals, 1083 criminal petitions, 1869 criminal petitions, 604 jail petitions, etc.
The Full Court meeting noted that proper attention could not be paid to the
disposal of cases during the year 2007, which led to the piling up backlog. However, the Court expressed its satisfaction over the pace of disposal during the last four and a half months, the press release said.
The Full Court also directed the concerned office to give priority in fixation of cases filed against interim orders in a much due to the pendency of such matters, cases remain pending before the lower forums and do not attain finality.
The Chief Justice also appreciated the dedicated efforts of the judges of the Supreme Court for speedy disposal of the cases.
The meeting also considered matters related to the welfare of the retired judges of the Supreme Court and directed the office to facilitate retired judges in every possible way.
The Full Court also examined the proposal of the office for up-gradation of posts of Supreme Court employees and enhancement of judicial allowance.
However, the Full Court directed the office to place these matters along with necessary details in the next meeting of the Full Court.

President wants better working relationship with new government: Spokeperson

ISLAMABAD, March 18 (APS): President Pervez Musharraf wants better working relationship with the forthcoming government for stability and prosperity of the country,said spokesman Major General® Rashid Qureshi.
Talking to mediapersons at Sports Gala held by Apples’ The Grooming School here on Tuesday, the spokesman said President Pervez Musharraf wished that newly elected assembly should complete its tenure and democracy flourish in the country.
He said President Pervez Musharraf fully respected the peoples’ mandate given to the parties in general elections. He said he President had fulfilled his promise to hold free and fair elections.
To a question, he said the National Assembly session for election of the Prime Minister would be called immediately whenever the Ministry of Parliamentary Affairs sends a summary to the President.
“Rumours regarding any delay in convening the NA session for election of the prime minister is baseless,” he said.
Later, Caretaker Minister for Women Development Barrister Shahida Jamil in her speech called for making concrete efforts to promote extra-curricula activities among students to enable them develop a balanced personality.
Besides studies, she said, the students as builders of the nation should keep themselves fit to discharge their future duties.
She stressed the need for taking sincere steps to attain socio-economic development She praised the school for promoting quality education and working hard to enable its students become good citizens of the country.
Later, she distributed awards among the winning students and appreciated their outstanding performance in different events.
Director of the school, Naheed Qureshi highlighted achievements of the institution and said increase in enrollment of students was a proof of its success.

Coalition partners finalize modalities for next cabinet

ISLAMABAD, Mar 18 (APS): As nomination of premiership candidate is expected within a few days, the PPP-led coalition partners have finalized the formula for distribution of cabinet slots among themselves.
A joint committee of Pakistan People’s Party (PPP), Pakistan Muslim League- Nawaz (PML-N), Awami National Party (ANP) and Jamiat Ulema Islam (JUI-F) continued meetings on Tuesday to draw-up an agreement for power-sharing.
Briefing the media om decision of the meeting, PML-N leader Chaudhry Nisar said that all the coalition partners have already completed the homework for power-sharing and an announcement is expected soon.
“We have finalised the modalities for cabinet and committee of every party would now present it before it’s leadership for approval,” he said.
“When PPP will announce the candidate for the prime minister next week, it would comprise names of ministers and their portfolios,” he added.
Another PML-N leader Ishaq Dar also endorsed Chaudhry Nisar’s statement, saying “there is nothing pending now.”
Central Information Secretary of PPP, Sherry Rahman said that the coalition partners would hold more meetings to maintain the confidence and mutual trust among themelves.
She said Pakistan People’s Party would give same respect to the coalition partners and a mutual consensus would always be evolved before taking important decisions.
Meanwhile, Pakistan People’s Party will get 20 out of 40 cabinet slots under the formula of parties’ ratio in the National Assembly.
According to sources PPP and PML-N had already agreed on distribution of cabinet slots however the formula was revised after ANP and JUI-F entered the future government scenario camp.
“Under the revised formula PPP will get 20 out of 40 cabinet slots, while, PML-N would be given 13 ministries .
The source said three ministries are to be given to ANP, JUI-F is to have two and FATA will get one respectively JUI-F and FATA would be given three, two and one ministries respectively”. .

Govt, Opposition nominees’ papers for Speaker, Dy Speaker filed, accepted

ISLAMABAD, Mar 18 (APS): Secretary National Assembly Tuesday accepted the nomination papers of the candidates of government and opposition parties for the slots of Speaker and Deputy Speaker. The nominees of both treasury and the opposition parties had filed their nomination papers with the Secretary National Assembly at the Parliament House on Tuesday morning.Dr. Fehmida Mirza and Faisal Karim Kundi, the PPP candidates for the slots of Speaker National Assembly and Deputy Speaker respectively, filed their nomination papers with the Secretary National Assembly here at the Parliament House.Both the PPP candidates, flanked by PPP leaders Raja Pervaiz Ashraf, Syed Naveed Qamar, Farzana Raja, Arbab Muhammad Zahir and others, reached Parliament House around 11 a.m. to file their papers.
Fehmida Mirza was proposed by MNAs Raja Pervaiz Ashraf, Syed Naveed Qamar, Farzana Raja, Arbab Muhammad Zahir, Maulana Qasim and Sardar Ayaz Sadiq.
Kundi was proposed by Dr. Azra Fazal Pichio, Mehreen Anwar Raja, Abdul Mateen Khan and Syed Khurshid Shah.
The candidates for both the slots from the opposition parties filed their papers around 11:30 a.m.
Chaudhry Shujaat Hussain, Ch. Pervaiz Elahi, Senator Muhammad Ali Durrani, Dr. Donia Aziz, Engr. Amir Muqam and others were also present.
Opposition candidate for Speaker’s slot Sardar Israr Tareen was proposed by Dr. Donia Aziz, S.A. Iqbal Qadri and Engr. Amir Muqam.
